Government to share info with SC collegiums on resolutions on HC chief justices

The Centre informed the Supreme Court on Thursday that it would provide details next week regarding the collegium’s pending recommendations for appointing chief justices in several high courts. Attorney General R. Venkataramani made the submission before a bench led by Chief Justice D.Y. Chandrachud, seeking an adjournment of a hearing on a public interest litigation (PIL) scheduled for Friday. The PIL, filed by advocate Harsh Vibhore Singhal, seeks a fixed time frame for the government to act on judicial appointments recommended by the Supreme Court collegium.

During the hearing, CJI Chandrachud noted that the Jharkhand government has filed a contempt petition against the Centre for delaying the appointment of Justice M.S. Ramachandra Rao as Chief Justice of the Jharkhand High Court, a recommendation pending with the Centre.

Previously, on September 13, the Attorney General informed the court of receiving “sensitive material” from the government, which had caused delays in implementing the collegium's recommendations. He stated that revealing this information publicly would not be in the best interest of the institution or the judges involved and requested to submit it in a sealed cover for the court's review.

The PIL argues that the absence of a time limit for notifying judicial appointments undermines judicial independence and jeopardizes the constitutional order. It seeks a directive that if no objection is raised within a fixed period, the appointments should automatically be considered confirmed. The plea emphasizes that arbitrary delays by the government in notifying appointments undermine the authority of the judiciary.

On July 11, the collegium recommended chief justices for seven high courts, including Delhi, Himachal Pradesh, Jammu and Kashmir, Kerala, Madhya Pradesh, Madras, and Meghalaya. However, these appointments are still awaiting the Centre's approval.
